TERMS & CONDITIONS

Welcome to Vismaya Greenlines. These Terms & Conditions govern all bookings, travel packages, transportation services, hotel reservations, sightseeing arrangements, visa assistance services and other travel-related services offered by Vismaya Greenlines. By making a booking, making payment, requesting services, using our website or participating in any tour organized by Vismaya Greenlines, you agree to be bound by these Terms & Conditions.


1. ACCEPTANCE OF TERMS


By booking any service offered by Vismaya Greenlines, the customer confirms that:

• They are legally competent to enter into a binding agreement.

• They have read and understood these Terms & Conditions.

• They are authorized to act on behalf of all passengers included in the booking.

• All travelers included in the booking agree to comply with these Terms & Conditions.


2. BOOKING CONFIRMATION


A booking shall be considered confirmed only upon receipt of the required payment, submission of required documents and issuance of confirmation by the Company.


All bookings remain subject to availability and confirmation from airlines, hotels, transport providers, activity operators and other suppliers.


The Company reserves the right to decline any booking request without assigning any reason.


3. PRICING POLICY


All package prices are subject to availability and may change due to hotel tariff revisions, airline fare changes, fuel surcharges, government taxes, currency fluctuations and supplier price revisions.


The Company reserves the right to revise prices prior to final confirmation.


4. PAYMENT TERMS


Customers shall make payments as per the payment schedule communicated by the Company.


Failure to make payments within the prescribed period may result in suspension of services, withholding of travel documents or cancellation of bookings.


The Company reserves the right to refuse services where outstanding payments remain unpaid.


5. CUSTOMER RESPONSIBILITIES


Customers shall:

• Provide accurate information.

• Carry valid identification documents.

• Follow local laws and regulations.

• Respect local customs and traditions.

• Follow instructions issued by tour coordinators and service providers.


Any consequences arising from non-compliance shall be the sole responsibility of the customer.


6. ACCURACY OF CUSTOMER INFORMATION


Customers are solely responsible for ensuring that all information provided during booking is accurate and complete.


This includes names, dates of birth, passport details, visa details, contact details and emergency contact information.


The Company shall not be liable for losses arising from incorrect or incomplete information provided by the customer.


7. CRIMINAL ACTIVITIES AND UNLAWFUL CONDUCT


The Company shall not be responsible for any unlawful, illegal, criminal, prohibited or objectionable activities committed by passengers during the tour.


This includes but is not limited to:

• Drug-related offences.

• Smuggling.

• Theft.

• Assault.

• Harassment.

• Vandalism.

• Immigration violations.

• Customs violations.

• Public disorder.

• Violation of local regulations.


Any fines, penalties, arrests, legal proceedings, deportation, imprisonment or liabilities resulting from such conduct shall be borne solely by the concerned passenger.


The Company shall have no obligation to provide legal assistance, compensation or reimbursement in such situations.


8. PASSENGER CONDUCT


Passengers shall behave in a respectful and responsible manner throughout the journey.


The Company reserves the right to refuse service or remove any passenger whose conduct is abusive, violent, threatening, disruptive, intoxicated or dangerous to other travelers.


No refund or compensation shall be payable in such circumstances.


9. CROWD MANAGEMENT AND PUBLIC EVENTS


Tourist destinations may experience large crowds, religious gatherings, political gatherings, demonstrations, festivals, public celebrations and traffic congestion.


The Company shall not be responsible for inconvenience, delays, injuries, losses or disruptions arising from such circumstances beyond its control.


Customers participate in tours at their own risk.


10. PASSENGER DELAYS AND MISSED SERVICES


Passengers are responsible for reporting at designated pickup points, airports, railway stations, hotels and meeting locations on time.


The Company shall not be responsible for losses resulting from late arrival, missed flights, missed trains, missed buses, missed transfers, missed sightseeing departures or failure to arrive at designated meeting points.


Additional expenses incurred to rejoin the tour shall be borne by the customer.


11. ITINERARY CHANGES


The Company reserves the right to modify itineraries due to weather conditions, road closures, security concerns, government restrictions, operational requirements, supplier-related issues or circumstances beyond its control.


Alternative arrangements may be provided where reasonably possible.


12. FORCE MAJEURE


The Company shall not be liable for delays, disruptions, losses or changes caused by circumstances beyond its reasonable control including floods, landslides, earthquakes, cyclones, storms, epidemics, pandemics, war, civil unrest, political disturbances, terrorist activities, transport strikes and airport closures.


Any resulting costs shall be borne by the customer.


13. HOTELS AND ACCOMMODATION


Hotels operate independently and maintain their own policies.


The Company shall not be responsible for hotel overbooking, service deficiencies, utility interruptions, maintenance issues, hotel policy changes or decisions made by hotel management.


Hotel photographs used for promotional purposes are representative and may differ from actual room allocations.


14. TRANSPORTATION LIABILITY


The Company acts only as a travel organizer and intermediary.


The Company shall not be liable for flight delays, flight cancellations, airline schedule changes, train delays, vehicle breakdowns, traffic congestion, mechanical failures or actions of independent transportation providers.


15. BAGGAGE LIABILITY


Passengers are solely responsible for their luggage and personal belongings.


The Company shall not be liable for loss, theft, damage, misplacement or forgotten belongings.


Customers are advised not to leave valuables unattended.


16. MEDICAL CONDITIONS


Customers must disclose any serious medical condition that may affect their travel.


The Company does not provide medical services.


All medical expenses, hospitalization expenses, emergency evacuation expenses and related costs shall be borne solely by the customer.


17. SENIOR CITIZEN AND HEALTH DISCLAIMER


Senior citizens, pregnant travelers and travelers with medical conditions travel at their own risk.


The Company shall not be liable for illness, injury, deterioration of health, hospitalization or death occurring during the trip.


18. ADVENTURE ACTIVITIES DISCLAIMER


Activities including trekking, skiing, horse riding, rafting, boating, snowmobile rides, ATV rides, gondola rides, ziplining, camping, hiking and water sports involve inherent risks.


Participation is voluntary and entirely at the customer's own risk.


The Company shall not be liable for injury, disability, property damage, accidents or death arising from such activities.


19. WEATHER AND NATURAL CONDITIONS DISCLAIMER


The Company does not guarantee snowfall, pleasant weather, clear visibility, wildlife sightings, seasonal blooms or specific environmental conditions.


Natural conditions are beyond the Company's control.


No claim shall arise solely because weather conditions differ from customer expectations.


20. VISA AND IMMIGRATION DISCLAIMER


Where visa assistance is provided, the Company acts solely as a facilitator.


Visa issuance remains entirely at the discretion of the relevant authorities.


The Company does not guarantee visa approval, processing time, immigration clearance or entry into any country.


21. TRAVEL INSURANCE


Travel insurance is strongly recommended for all travelers.


The Company shall not be liable for losses that could otherwise be covered by travel insurance.


22. CHARGEBACK AND PAYMENT DISPUTES


Customers agree to first contact the Company regarding any payment-related concerns before initiating chargebacks or payment disputes.


The Company reserves the right to contest unjustified chargebacks and recover associated costs where permitted by law.


23. SOCIAL MEDIA, REVIEWS AND DEFAMATION


Customers may provide honest feedback regarding services.


However, customers shall not publish knowingly false, defamatory, malicious or misleading statements intended to damage the Company's reputation.


The Company reserves all legal rights available under applicable laws.


24. PHOTOGRAPHY AND PROMOTIONAL USE


Unless expressly declined in writing prior to departure, customers grant permission to the Company to use photographs, videos, testimonials and tour-related content for marketing and promotional purposes.


25. WEBSITE DISCLAIMER


Information published on the website is provided in good faith.


The Company does not guarantee that all content will be free from errors, omissions or inaccuracies.


The Company reserves the right to update website content without notice.


26. INTELLECTUAL PROPERTY


All content displayed on the website including logos, photographs, videos, graphics, text and designs is the property of Vismaya Greenlines and is protected by applicable intellectual property laws.


Unauthorized use is prohibited.


27. LIMITATION OF LIABILITY


To the maximum extent permitted by law, the Company's liability shall be limited to the amount actually paid by the customer for the specific booking.


The Company shall not be liable for indirect, consequential, incidental, special or punitive damages including loss of business, loss of profit, loss of opportunity, emotional distress or travel-related inconvenience.


28. CUSTOMER INDEMNITY


Customers agree to indemnify and hold harmless Vismaya Greenlines, its owners, employees, agents, coordinators, affiliates and service providers from any claims, losses, damages, liabilities, costs or legal expenses arising from violation of these Terms, illegal conduct, negligence, misrepresentation or damage caused by the customer to third parties.


29. SEVERABILITY


If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


30. ENTIRE AGREEMENT


These Terms & Conditions together with the Privacy Policy and Cancellation & Refund Policy constitute the entire agreement between the customer and Vismaya Greenlines.


31. GOVERNING LAW


These Terms & Conditions shall be governed and interpreted in accordance with the laws of India.


32. JURISDICTION


Any dispute, claim or legal proceeding arising out of or relating to the services provided by Vismaya Greenlines shall be subject exclusively to the jurisdiction of the competent courts located in Chavakkad, Thrissur District, Kerala, India.
